Introduction

Contract

You acknowledge that utilising our services (defined below), clicking "Join Now," "Join DizShore," "Sign Up," or similar buttons, registering, or accessing them constitutes your agreement to enter into a contractual contract with DiziShore.com (even if you are using our Services on behalf of a company). Do not click "Join Now" (or a similar button) or access or otherwise make use of any of our Services if you do not agree to this contract ("Contract" or "User Agreement"). You may end this agreement at any time by deactivating your account and ceasing an access to or use of our Services.

Services

These provisions in this Contract applies to DiziShore.com, DiziShore-branded apps and other services that state that they are offered under these terms (“Services”), including the offsite collection of data for those Services, such as our ads. Registered users of our Services are “Members'' and unregistered users are “Visitors''.

‘DiziShore’

You are entering into this Contract with ‘DiziShore’ (also referred to as “we” and “us”).

We use the term “Designated Countries” to refer to countries in the European Union (EU), European Economic Area (EEA), and Switzerland.

Members and Visitors

When you register and join the ‘DiziShore’ Services, you become a Member. If you have chosen not to register for our Services, you may access certain features as a “Visitor.”

Change

We reserve the right to periodically change these terms, our Privacy Policy, and our Cookies Policy and/or any policy of ‘DiziShore’., It is your responsibility to review this Agreement periodically. Your continued use of the Platform following the posting of revised means that you accept and agree to the changes. You are expected to check this page frequently, so you are aware of any changes, as they are binding on you. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised provisions.

Obligations

Your Account

You will keep your password a secret.

You will not share an account with anyone else and will abide by our policies and procedures.

Accounts are held by members. You consent to the following obligations: (1) use a secure password; (2) keep it private; (3) adhere to the law; and (4) not transfer any part of your account, such as connections. Unless you deactivate your account or report abuse, you are accountable for everything that occurs through it.

Payment

You agree to let us save your payment information and will honour your financial commitments. You are aware that our prices may include applicable fees and taxes.

Refunds are subject to our Refund & Returns policy.

If you buy any of our paid Services or products, you agree to pay us the applicable fees and taxes and to additional terms specific to the paid Services. Failure to pay these fees will result in the termination of your paid Services or products. Also, you agree that:

●    Your purchase may be subject to foreign exchange fees or differences in prices based on location (e.g. exchange rates).

●    We may store and continue billing your payment method (e.g. credit card) even after it has expired, to avoid interruptions in your Services and to use to pay for other Services /Products you may have bought.

●    If you purchase a subscription, your payment method automatically will be charged at the start of each subscription period for the fees and taxes/VAT applicable to that period. To avoid future charges, cancel before the renewal date.

●    All of your purchases are subject to DiziShore’s Returns & Refund policy.

●    We may calculate taxes payable by you based on the billing information that you provide us at the time of purchase.

You can get a copy of your invoice through your DiziShore.com account.

Notices and Messages

You’re okay with us providing notices and messages to you through our websites, apps, and contact information. If your contact information is out of date, you may miss out on important notices.

You agree that we will provide notices and messages to you in the following ways: (1) within the Service, or (2) sent to the contact information you provided us (e.g., email, mobile number, physical address). You agree to keep your contact information up to date.

Please review your settings to control and limit messages you receive from us.

Sharing

With the help of our services, you may communicate with others and share information in a variety of ways, including through your profile, articles, group posts, ads, messages, and InMails etc. Your shared or posted content and information may be viewed by other members, visitors, or third parties (including off of the Services). Where we have provided settings, we will respect the selections you make regarding who can access content or information (e.g., message content to your addressees, sharing content only to DiziShore.com connections, restricting your profile visibility from search engines, or opting not to notify others of your ‘DiziShore’ profile update). 

Minimum Age

Persons under the age limit set by the state are not eligible to use our Services.

Rights and Limits

Your Licence of Using 'DiziShore'

You own all of the content, feedback and personal information you provide to us, but you also grant us a non-exclusive licence to it.

We’ll honour the choices you make about who gets to see your information and content, including how it can be used for ads.

As between you and DiziShore.com, you own the content and information that you submit or post to the Services, and you are only granting DiziShore.com and our affiliates the following non-exclusive licence:

A worldwide, transferable and sublicensable right to use, copy, modify, distribute, publish and process, information and content that you provide through our Services and the services of others, without any further consent, notice and/or compensation to you or others. These rights are limited in the following ways:

1.    You can terminate this licence for a specific piece of content by removing it from the Services or, more generally, by closing your account, with the exception of (a) any instances in which you shared the content as part of the Service with third parties and they copied, reshared, or stored it, and (b) while it takes a reasonable amount of time to remove the content from backup and other systems. 

2.    Without your separate authorisation, we won't use your content in advertisements for the goods and services of third parties (including sponsored content). However, as stated in the Privacy Policy, we reserve the right to serve advertising close to your content and information without charging you or anyone else, and it's possible that these ads will show your social media activity. Depending on your choices, if you utilise a Service feature, we might mention that along with your name or photo to advertise that function within our Services.

3.    If we want to grant others the right to publish your content outside of the Services, we will first obtain your permission.

4.    We reserve the right to edit and format your content (including adding or removing metadata, changing the size, layout, or file type), but we won't change the meaning of what you say.

5.    Because you own your content and information and we only have non-exclusive rights to it, you may choose to make it available to others.

You and DiziShore.com agree that if the content includes personal data, it is subject to our Privacy Policy.

You and DiziShore.com agree that we may access, store, process and use any information and personal data that you provide in accordance with the terms of the Privacy Policy and your choices (including settings).

You affirm that your DiziShore.com profile will be accurate and that you will only share information and content that you are authorised to share. 

You affirm that you will only provide content or information that complies with the law and upholds people's rights (including intellectual property rights). Additionally, you agree that the data on your profile will be true. DiziShore.com might be required by law in some nations to remove particular data or content.

Service Availability

We may change or end any Service or modify our prices prospectively.

We may change, suspend or discontinue any of our Services. We may also modify our prices effectively prospectively upon reasonable notice to the extent allowed under the law.

We don’t promise to store or keep showing any information and content that you’ve posted. ‘DiziShore’ is not a storage service. You agree that we have no obligation to store, maintain or provide you with a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.

Other Content, Sites and Apps

Your use of other’s content and information posted on our Services, is at your own risk.

Others may offer their own products and services through our Services, and we aren’t responsible for those third-party activities.

When using the Services, you can come across content or information that is incorrect, lacking, delayed, deceptive, unlawful, objectionable, or otherwise harmful. In general, DiziShore.com does not examine content submitted by our Members or by third parties. You acknowledge that we are not liable for the content or information of third parties (including other Members). You acknowledge that we are not always able to stop this usage of our services, and that we are not liable for any such misuse. 

Limits

We have the right to limit how you connect and interact on our Services.

DiziShore.com reserves the right to limit your use of the Services, including the number of your connections and your ability to contact other Members. DiziShore.com reserves the right to restrict, suspend, or terminate your account if you breach this Contract or the law or are misusing the Services (e.g., violating any of the Dos and Don’ts or Policies).

Intellectual Property Rights

We’re providing you with notice about our intellectual property rights.

All of DiziShore's intellectual property rights in the Services are reserved. The Services may contain trademarks and logos that belong to their respective owners. DiziShore.com is the owner of the logo, "DiziShore," other ‘DiziShore’ trademarks, service marks, images, and logos used  this website.

Automated Processing

We use data and information about you to make relevant suggestions to you and others.

Based on the information and data you offer and that we already have about Members, we recommend connections, content, and features that you might find useful. We can increase the relevance and quality of our recommendations by maintaining an up-to-date and accurate profile for your social action e.g., likes, comments, follows, share etc.

Disclaimer and Limit of Liability

No Warranty

This is our disclaimer of legal liability for the quality, safety, or reliability of our Services.

DiziShore.com and its affiliates make no representation or warranty about the services, including any representation that the services will be uninterrupted or error-free, and provide the services (including content and information) on an “as is” and “as available” basis. To the fullest extent permitted under applicable law, DiziShore.com and its affiliates disclaim any implied or statutory warranty, including any implied warranty of title, accuracy of data, non-infringement, merchantability or fitness for a particular purpose.

Exclusion of Liability

The extent of our potential legal liability to you is set forth below.

To the fullest extent permitted by law (and unless DiziShore.com has entered into a separate written agreement that overrides this contract), DiziShore.com, including its affiliates, will not be liable in connection with this contract for lost profits or lost business opportunities, reputation (e.g., offensive or defamatory statements), loss of data (e.g., downtime or loss, use of, or changes to, your information or content) or any indirect, incidental, consequential, special or punitive damages.

Basis of the Bargain; Exclusions

The exclusions of liability in this Section are an integral part of the agreement between you and DiziShore.com and shall apply to all liability claims (such as those based on warranty, tort, negligence, contract, and law), even if DiziShore.com or its affiliates have been informed of the potential for any such damages and even if these remedies are ineffective in alleviating your particular situation.

Governing Law and Dispute Resolution

Any disputes arising out of our association in any way whatsoever will be governed by, interpreted and constructed in accordance with the law of England and Wales.

General Terms

You agree that if a court with jurisdiction over this Contract determines any provision of it to be unenforceable, the court should change the provisions to make that provision enforceable while still accomplishing the original purpose. If the court is unable to accomplish that, you and we agree to ask the court to strike out the unenforceable portion of the contract while upholding the remainder. 

This Contract is the exclusive agreement between us relating to the Services and replaces all prior agreements for the Services (including any other terms that may be supplied by us when you use a feature of the Services).

Complaints Regarding Content

Contact information and methods are available for complaints on the website of the DiziShore.com.

We honour other people's rights to their intellectual property. We demand that all information uploaded by Members be true and not infringe any third party's intellectual property rights or other rights.
